Terms of Service

This Terms of Service (hereinafter referred to as the "Agreement") sets forth the terms and conditions for the use of LingoBuddy App(hereinafter referred to as the "Service") provided by LingoBuddy (hereinafter referred to as the "Service Provider"). Users (hereinafter referred to as "Users") are required to use the Service in accordance with this Agreement.

Article 1 (Application)

This Agreement shall apply to all relationships related to the use of the Service between the User and the Service Provider.

The Service Provider may establish rules, etc., and various regulations (hereinafter referred to as "Individual Provisions") in addition to this Agreement regarding the Service. Regardless of their name, these Individual Provisions shall constitute a part of this Agreement.

In the event of any conflict between the provisions of this Agreement and the Individual Provisions of the preceding article, unless otherwise provided in the Individual Provisions, the provisions of the Individual Provisions shall prevail.

Article 2 (User Registration)

Users shall apply for user registration by agreeing to this Agreement and following the method specified by the Service Provider, and user registration shall be completed upon approval by the Service Provider.

The Service Provider may not approve the application for user registration if the applicant falls under any of the following reasons:

The applicant has violated this Agreement in the past.

There is a suspicion of malicious use such as harassment.

Article 3 (Management of User ID and Password)

Users shall be responsible for appropriately managing their registered email address and password for the Service.

Except in cases where the Service Provider is intentionally or grossly negligent, the Service Provider shall not be liable for any damages arising from the use of the email address and password by a third party.

Article 4 (Usage Fee and Payment Method)

Users shall pay the usage fee displayed on the website by the Service Provider for the paid part of the Service by the method specified by the Service Provider.

Article 5 (Prohibited Matters)

Users shall not engage in the following acts when using the Service:

Acts that infringe the copyrights, trademarks, and other intellectual property rights included in the content of the Service.

Unauthorized access or attempted unauthorized access.

Acts that may interfere with the operation of the Service.

Impersonating other users.

Article 6 (Suspension of Service Provision, etc.)

The Service Provider may suspend or interrupt the provision of all or part of the Service without prior notice to the User if any of the following reasons apply:

Maintenance or update of the computer system for the Service.

Difficulty in providing the Service due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters.

Serious system failure has occurred.

Other situations where the Service Provider deems it difficult to provide the Service.

The Service Provider shall not be liable for any disadvantages or damages incurred by the User or a third party due to the suspension or interruption of the provision of the Service.

Article 7 (Restriction on Use and Deregistration)

The Service Provider may restrict the use of all or part of the Service, or deregister the User, without prior notice to the User, if the User falls under any of the following:

Violation of any provision of this Agreement.

Non-performance of payment obligations such as fees.

Other cases where the Service Provider deems the use of the Service inappropriate.

The Service Provider shall not be liable for any damages incurred by the User due to the actions taken by the Service Provider based on this Article.

Article 8 (Withdrawal)

Users may withdraw from the Service by following the procedures on the withdrawal page within the application.

Article 9 (Disclaimer and Exemption)

The Service Provider does not guarantee or warrant that the Service is free from defects in fact or law, including safety, reliability, accuracy, completeness, effectiveness, suitability for a specific purpose, and security.

The Service Provider shall not be liable for any damages incurred by the User due to the Service, except in cases of intentional or gross negligence by the Service Provider.

Disclaimer for Offline Use: The Service is designed for use in situations where an internet connection is available. The Service Provider does not guarantee the performance of the application in offline situations. The User acknowledges that some features of the Service may be limited when used offline, and the User assumes full responsibility for such use.

Article 10 (Change in Service Content, etc.)

The Service Provider may change, add, or discontinue the content of the Service with prior notice to the User, and the User shall consent to such changes.

Article 11 (Amendment of Terms of Service)

The Service Provider may amend this Agreement without obtaining individual consent from the User in the following cases:

When the amendment to this Agreement is in the general interest of the User.

When the amendment to this Agreement does not contradict the purpose of the Service usage agreement and is reasonable in terms of necessity for the amendment and appropriateness of the content after the amendment.

The Service Provider shall notify the User of the amendment to this Agreement in advance and inform the User of the details of the amended Agreement and the effective date of the amendment.

Article 12 (Handling of Personal Information)

The Service Provider shall handle the personal information obtained through the use of the Service appropriately in accordance with the Service Provider's Privacy Policy.

Article 13 (Notice or Contact)

Notifications or contacts between the User and the Service Provider shall be made through the method specified by the Service Provider. The Service Provider shall consider the currently registered contact information valid unless the User submits a change notification in the manner prescribed by the Service Provider, and such notifications or contacts shall be deemed to have reached the User at the time of transmission.

Article 14 (Governing Law and Jurisdiction)

This Agreement shall be governed by Japanese law.

In the event of a dispute regarding the Service, the exclusive jurisdiction shall be the court having jurisdiction over the location of the Service Provider's headquarters.
